Terms and Conditions

  • By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These terms and condition apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
  • Please read these terms and condition carefully before accessing or using our website. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
  • All prices of flowers and gifts are in Malaysian Ringgit. Prices are subject to change without prior notice. Please note that purchases are payable to “Infinitact Marketing” as the owner of FloryGift.com.my.
  • You warrant that you are at least 18 Years of age when you order any Goods or Services through our website; you agree to present valid identification, if requested during delivery, to prove your age.
  • By Malaysia law, purchasers of alcohol beverages must be at least eighteen (18) years of age and non-Muslim. Furthermore, you may not purchase alcohol beverages for anyone who is under the age of eighteen (18) or who is Muslim. We will require you to present valid identification every time you purchase alcohol. If you cannot present valid identification at time of delivery the merchandise will be returned by us, and you will be billed for it.
  • You are also required to understand and agree to our delivery information at Flower Delivery in Malaysia & Florist Delivery Schedule.
  • Any dispute or claim shall be officially logged in and communicated either through email at [email protected] or telephone call to our team within 24 hours after receiving the goods. Please provide order number, item purchase and reason of claim.
  • FloryGift reserves the right not to guarantee that the item will be exactly the same as shown in the webpages or catalog. Product and fruits or flowers may be subjected to change as per availability and shipping needs.
  • FloryGift.com.my reserves the right, at it’s sole discretion, to change, modify, add or remove portions of these website content including Terms and Conditions, at any time, without prior notice.
  • You agree to indemnify, defend and hold harmless to FloryGift or Infinitact Marketing including our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Order, Product & Delivery

  • Orders will be confirmed and fulfilled only with full payment received, according to the actual value of the order. All orders and other requests received are subject to acceptance by FloryGift, and any of its personnel, reserve the right, at our absolute discretion, to reject or cancel any order without providing reasons. In the event of rejection or cancellation, we will refund any payments received in full, via the payment method used to place the order.
  • In the event that any flowers, products or packing material become unavailable at the time of production, FloryGift reserves the right to substitute them with similar flowers, products or packing of equal or greater value to fulfill the order and delivery with or without prior notice to customer.
  • FloryGift will try the best to deliver according to the requested date and time range. FloryGift will make only 2 attempts to contact the recipient for delivery purpose. In the event that the recipient is not contactable and/or is not present at the delivery address during arrival of the delivery, or if there is any other reason of unsuccessful delivery for which FloryGift is not liable, FloryGift will enter into correspondence with the customer. With an agreed additional fee, FloryGift would arrange to have the order re-deliver at a later date or to re-direct the delivery to another location. You are required to read and understand our detail at Flower Delivery in Malaysia & Florist Delivery Schedule.
  • For festive seasons order (e.g Valentine’s Day, Mother’s Day, Hari Raya, Deepavali, Christmas, Chinese New Year etc), where there is an unusually greater demand for delivery, FloryGift will try the best to accommodate the delivery timing requested as practically possible. Order fulfilling are based on first come first serve basis. Delivery might not be delivered on the exact requested date. Delivery during these peak seasons are open date which means delivery will be completed progressively on ANY-DAY for the festive day. FloryGift reserves the rights to bring forward or backward the delivery time and date to accommodate the open date scheduling.
  • Outstation delivery or delivery to outside of Kuala Lumpur-Selangor using courier services required at least 3 working days or even longer during peak seasons. The delivery schedule will be subjected to the time & delivery of the courier services dispatch, which is beyond FloryGift to control. All courier delivery services will be subjected to the terms and conditions as provided by the courier service company.
  • Packing and arrangement would be customized to suit for courier delivery handling in order to protect the gift items, especially for hampers delivering outside of Kuala Lumpur-Selangor.
  • FloryGift reserves the rights to replace any item that is not suitable for courier delivery outside of Kuala Lumpur-Selangor, such as fresh flowers or fruits. Any beverages sending to East Malaysia will be replace as well in order to be shipped via air-freight courier.
  • We do everything we can to ensure our flowers & gifts are delivered. If for any reason we made a mistake and deliveries don’t turn up, please contact our customer care at [email protected] to inform us. We will send you a replacement on our next available delivery date, or we may offer a refund with cancellation of order.
  • In rare cases of late delivery due to circumstances beyond our control, FloryGift will not be liable for any claims arising out of such situations. Non delivery due to reasons such as natural disasters, acts of God, violent/warlike situations and/or other reasons beyond our control will not be considered as a violation of agreement.

Cancellation, Return and Refund Policy

  • Any request of cancellation of order is subjected to either no refund or only partial refund. FloryGift may be charging processing fees of at least 5% of the total purchase.
  • In any cancellation case that the ordered item has already been prepared, FloryGift may refund 50% of the purchase product price.
  • Cancellation of order that already in the progress of delivery will not be accepted. Delivery would still be continue as arrangement has been made. FloryGift will still consider as delivery has been completed and no refund can be claim.
  • FloryGift would offer refund or replacement only in the event of negligence by FloryGift. We cannot be held responsible and to provide refund or replace on flowers or gifts affected by circumstances beyond our control. This include broken, damage or neglect after goods are received or goods being stored in extreme environment after received.
  • If despite the care we have taken, the flowers delivered are not fresh during receiving, FloryGift will deliver another bouquet of equivalent value at no charge.
  • In any case that FloryGift request to return of the goods, the goods to return should be in original condition and packaging in which they arrived. FloryGift will able to collect the return goods only if is within Kuala Lumpur-Selangor, otherwise sender or recipient is required to arrange shipping sending the return goods to FloryGift. Returned goods will be checked and any agreed refund or replace will be made within 14 days.
  • FloryGift will not consider to refund, return or replace in the event of late or non-delivery of the flowers or gifts especially in the following circumstances:
    • The recipient of the order made is not present at the address given and there is no one else present to receive the delivery on behalf of the recipient.
    • The delivery address is incorrect.
    • Recipient not answering call or text messages, telephone number not provided or an invalid number is given.
    • Delayed or missed shipping by third party courier service providers.
  • Refusal of receiving any item by the recipient if it is not due to product faulty, FloryGift will still consider as delivery has completed and no refund can be claim.
